monimoni Terms of Service

These Terms of Service (these "Terms") set out the conditions for using the mobile application "monimoni" (the "Service") provided by the monimoni operations team ("we," "us," or "our"). Please read these Terms carefully before using the Service. By using the Service, you are deemed to have agreed to all of the provisions of these Terms.

Article 1 (Definitions)

  1. "User" means any individual who uses the Service after agreeing to these Terms.
  2. "Content" means any text, images, audio, and other information that a User posts or transmits on the Service.
  3. "Premium Features" means paid features available for purchase through Apple's In-App Purchase.

Article 2 (Application)

  1. These Terms are intended to define the conditions for providing the Service and the relationship between Users and us, and apply to all matters relating to the use of the Service between Users and us.
  2. Any guidelines or individual rules that we post within the Service form part of these Terms.
  3. If any provision of these Terms conflicts with an individual rule, the individual rule shall prevail.

Article 3 (Registration)

  1. Users may register for the Service through authentication using an Apple ID or Google account.
  2. Persons under the age of 13 may not use the Service. Persons aged 13 to under 18 must obtain the consent of a parent or guardian before using the Service.
  3. We may decline an application for registration if we determine that the applicant:

Article 4 (Account Management)

  1. Users shall appropriately manage their account information at their own responsibility.
  2. Users may not, under any circumstances, transfer, lend, or share their account with any third party.
  3. We shall not be liable for any damage arising from the unauthorized use of account information, except in cases of our willful misconduct or gross negligence.

Article 5 (Content of the Service)

  1. The Service provides SNS functionality that allows Users to share their wake-up times and wake each other up via voice calls.
  2. One-on-one voice calls on the Service are limited to a maximum of 120 seconds.
  3. As a recovery option when a call is not completed, the Service provides a feature to send the other party an audio message of up to 20 seconds (a "Voice Message"). Voice Messages are delivered together at the recipient's scheduled wake-up time.
  4. We may change, add to, or discontinue the content of the Service without prior notice.

Article 6 (Prohibited Acts)

Users must not engage in any of the following acts when using the Service:

  1. Acts that violate laws or public order and morals;
  2. Acts related to criminal activity;
  3. Acts that destroy or interfere with the functions of the Service's servers or network;
  4. Acts that may interfere with the operation of the Service;
  5. Acts that improperly collect, store, or use personal information about other Users;
  6. Unauthorized access or attempts thereof;
  7. Impersonating other Users;
  8. Acts that infringe the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of other Users, third parties, or us;
  9. Transmitting obscene, discriminatory, violent, or other information contrary to public order and morals through the Service;
  10. Harassing, stalking, defaming, or threatening other Users;
  11. Recording, filming, or publishing conversations during a voice call without the consent of the other party;
  12. Recording another person's voice without permission and sending it as a Voice Message;
  13. Sending, via Voice Message, audio that is defamatory, obscene, violent, or otherwise contrary to public order and morals;
  14. Using the Service for sales, advertising, or solicitation purposes;
  15. Directly or indirectly providing benefits to antisocial forces;
  16. Any other acts that we deem inappropriate.

Article 7 (Suspension of the Service)

  1. We may suspend or interrupt all or part of the Service without prior notice to Users if we determine that any of the following applies:
  2. We shall not be liable for any disadvantage or damage suffered by Users or third parties as a result of the suspension or interruption of the Service, except in cases of our willful misconduct or gross negligence.

Article 8 (Usage Restrictions and Deregistration)

  1. We may, without prior notice, restrict all or part of a User's use of the Service or delete a User's registration if the User falls under any of the following:

Article 9 (Withdrawal)

Users may withdraw from the Service at any time by using the "Delete Account" feature within the app. The handling of data upon withdrawal shall be governed by the separately defined Privacy Policy.

Article 10 (Paid Subscriptions)

  1. The Service offers paid subscriptions ("Paid Features") available for purchase through Apple's In-App Purchase.
  2. The fees, contract period, and benefits of Paid Features shall be as displayed on the purchase screen within the app.
  3. Unless auto-renewal is canceled at least 24 hours before the end of the current period, the subscription will automatically renew for the same period, and the renewal fee will be charged to the Apple ID.
  4. Cancellation of auto-renewal and termination can be performed from iOS "Settings" → "Apple ID" → "Subscriptions."
  5. A free trial period may be offered for new purchases. The conditions of the trial are displayed on the purchase screen within the app.
  6. In principle, fees already paid are non-refundable. Refunds are subject to Apple's policy (https://support.apple.com/en-us/HT204084).
  7. We may change, add to, or discontinue the fees, content, or conditions of Paid Features without prior notice.

Article 11 (Display of Advertisements)

  1. The Service may display advertisements via Google AdMob to users on the free plan.
  2. Personalization of advertisements requires user permission via the iOS App Tracking Transparency (ATT) framework. Even without permission, non-personalized advertisements will be displayed.

Article 12 (Handling of Content)

  1. The copyright of Content posted or transmitted by a User on the Service belongs to that User.
  2. The User grants us a non-exclusive right to use such Content to the extent necessary for providing, improving, and promoting the Service.
  3. The User warrants that the Content they post does not infringe the rights of any third party.
  4. The content of voice calls passes through a third party's (Agora.io) servers for technical connection, but we do not record or store call content.
  5. Audio data sent as a Voice Message is temporarily stored on Firebase Storage and automatically deleted after the prescribed retention period. Please see the Privacy Policy for details.

Article 13 (Notification Features)

  1. The Service may send push notifications such as wake-up time notices, nomination notifications, heart-received notifications, and streak-related notifications.
  2. The types of notifications can be individually enabled or disabled from "Notification Settings" within the app.
  3. The Service may use the iOS Live Activities feature to display wake-up time information on the Lock Screen and Dynamic Island.

Article 14 (Disclaimer of Warranties and Limitation of Liability)

  1. We do not expressly or impliedly warrant that the Service is free from defects in fact or in law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, and infringement of rights).
  2. We shall not be liable for any damage caused to Users arising from the Service, except in cases of our willful misconduct or gross negligence.
  3. Even in cases based on our willful misconduct or gross negligence, our liability for damages shall be limited to the total amount paid by the User to the Service during the most recent 12 months.
  4. We shall not be liable for any transactions, communications, or disputes arising between a User and other Users or third parties in connection with the Service.

Article 15 (Changes to Service Content)

We may change the content of the Service or discontinue the provision of the Service without notice to Users, and shall not be liable for any damage caused to Users thereby.

Article 16 (Changes to the Terms)

  1. We may change these Terms at any time without notice to Users when we deem it necessary.
  2. The revised Terms shall take effect from the time they are posted within the Service.
  3. If a User uses the Service after the revision of these Terms, the User is deemed to have agreed to the revised Terms.

Article 17 (Handling of Personal Information)

We shall appropriately handle personal information obtained through the use of the Service in accordance with our Privacy Policy.

Article 18 (Notice or Contact)

Notices or communications between Users and us shall be made by the method prescribed by us. Unless a User submits a change in accordance with a separately prescribed method, we shall deem the currently registered contact information to be valid and provide notice or contact to that contact information, and such notice or contact shall be deemed to have reached the User at the time of transmission.

Article 19 (Prohibition of Assignment of Rights and Obligations)

Users may not assign to a third party, or use as collateral, their contractual status or any rights or obligations under these Terms without our prior written consent.

Article 20 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. In the event of a dispute concerning the Service, the Tokyo District Court shall have exclusive agreed jurisdiction as the court of first instance.
